Ernst & Young’s head of tax policy, Chris Sanger, and financial services tax partner Vincent Oratore, have been appointed to HM Treasury’s newly created Tax Professionals Forum, which will oversee reforms to the framework for developing tax policy and the making of tax law.

The forum will draw on the expertise of eight leading figures from across the tax profession, to look at how tax policy is developed, legislated and implemented, to ensure that the UK’s Tax system fosters a competitive environment for business. Chaired by the Exchequer Secretary David Gauke MP, the forum will meet bi annually.

Chris Sanger joined Ernst & Young as a Partner in 2005. He was formerly an adviser to HM Treasury, advising the Chancellor of the Exchequer, Junior Ministers and Special Advisers on the reform of the business taxation system. He is now Global Head of Tax Policy at Ernst & Young, Chairman of the Tax Faculty of the Institute of Chartered Accountants in England and Wales, and Vice-Chairman of the Management of Taxes committee of the Chartered Institute of Taxation.

Vincent Oratore is a financial services partner at Ernst & Young, and works with a multinational portfolio of clients. Vincent specialises in advising the financial services sector on the tax implications of transactions in the capital markets. In addition to his role at Ernst & Young, Vincent is also President of the Chartered Institute of Taxation and a Liveryman of the Worshipful Company of Tax Advisors.

Commenting on his appointment, Chris Sanger said: “In an environment where multinational companies can often work as easily from Switzerland as they can from the UK, maintaining the UK’s competitiveness is a major challenge for the Coalition government. Competitiveness is about a lot more than just the headline rates of tax. In order to remain an attractive destination for business, UK tax policy needs to address the tax base and tax administration.”

Vincent Oratore added: “It is really encouraging that, through this group, reforms to tax policy making will be informed by those in the profession. Through consultation and the combined experience of the forum’s members, we can help provide a framework for tax policy that provides both certainty and clarity in the short term and beyond.”

The Chancellor George Osborne and Exchequer Secretary David Gauke today established the Office of Tax Simplification (OTS).

The Chancellor has appointed a Board of tax experts who will be responsible for leading the work of the OTS over the next year. The Board Members are Michael Jack (Chairman) and John Whiting (Tax Director).

Their responsibilities will be to identify areas where complexities in the tax system for both businesses and individual taxpayers can be reduced and to publish their findings for the Chancellor to consider ahead of his Budget.

The OTS will undertake two initial reviews over the coming year. They will focus on tax reliefs and small business tax simplification (including IR35). The OTS will publish the initial findings from their work on reliefs in late autumn and on small business tax by the 2011 Budget.

The OTS will also draw on external expertise from the tax and legal profession over the coming months. These experts will focus on specific areas of complexity in the tax system and provide additional advice to the OTS.

The Government is committed to making the UK the most competitive country in the G20 and to reducing the complexity in the tax system. Over the past decade, the tax code doubled to more than 11,000 pages and the UK slipped from 7th to 13th in the World Economic Forum’s Global Competitiveness Index between 1997 and 2009-10.

This trend needs to be reversed, and the OTS is an important part of making the tax system work better for the taxpayer.

Chancellor George Osborne said:

“The previous Government took a complex tax system and made it even worse. A decade of meddling and intervening has made the tax affairs of millions of families and businesses across the UK extremely complicated. We need to sort out this mess.

“Two years ago I promised to create the Office of Tax Simplification. Today, we’re delivering on that promise. With its independent, expert advice it will be a permanent force for a simpler tax system.

“Simpler, more competitive taxes will help us show the world that Britain is open for business.”

The Rt Hon Michael Jack, the Chair of the OTS, said:

“Entrepreneurship should never be stifled because of an overly complex tax system. That’s why I am delighted that the Government have committed themselves to looking at ways to simplify the tax system, with an initial focus on small businesses.

“Simplification in a complex world is a real challenge, but it’s one that has to be addressed if the tax system is not to hinder the economy’s ability to grow.”

John Whiting, the Tax Director of the OTS, said:

“I’ve long argued that we need a simpler tax system in the UK, so I’m delighted to be given the opportunity to take forward the Government’s commitment in that direction.

“In our complex world a truly simple tax system for all is probably impossible, but working towards a simpler system will help all who deal with it: taxpayers, especially the unrepresented, tax advisers and tax authorities.”

LeSage, 50, has been named national managing partner – tax for KPMG LLP, the U.S. audit, tax and advisory firm, according to an announcement today by John B. Veihmeyer, chairman and CEO of the firm.

Ozanus, who most recently was the U.S. firm’s west region managing partner – tax, succeeds Shaun Kelly, who will remain on the firm’s management committee, as he takes on another senior role for KPMG LLP, as the vice chair-operations.

LeSage succeeds Frederick “Rick” Smith as national managing partner – tax. Smith has assumed a key role within KPMG International. As vice chair – tax, Ozanus will be a member of the firm’s management committee and will direct a team of more than 4,000 KPMG tax partners and professionals. Prior to heading the west region for tax, he served as southwest area managing partner and managing partner of KPMG’s Dallas office. Ozanus has been lead partner for a wide range of public and private domestic and international companies, with a particular focus on private equity. Ozanus is a member of the Texas and American Institutes of Certified Public Accountants and is a graduate of Texas A&M University. Active in the Dallas community, he serves as chairman of the board, United Way of Metropolitan Dallas, as a board member of the Cox School of Business, and as vice-chair of Texas Heart Hospital Baylor Plano.

“We’re looking forward to Scott’s leadership during this important period for our tax practice and KPMG’s clients – as companies cope with legislative and regulatory changes, and seek clarity in complex challenges related to transfer pricing, restructuring, renewable energy and a variety of other areas,” Veihmeyer said. Henry Keizer, deputy chairman and COO of KPMG LLP said, “Scott Ozanus and Jeff LeSage are highly prepared to take on their new responsibilities leading the tax practice. Most important, they have an unwavering commitment to professionalism and client service, along with the strong team-building skills required to lead our national tax team of partners and professionals.” J

A change at the top of Noerr’s Tax and Private Clients Department is pending. Stefan Hölzemann (44), who has, together with Georg Edelmann (44), headed the department, will return as a board member to WTS World Tax Service in Munich at the end of August. He came to Noerr from that position in 2006. Both Edelmann and Hölzemann are Noerr Munich partners.

The Düsseldorfer partner Dr. Lutz Schmidt (47) will replace Hölzemann. Edelmann and Schmidt know each other from their time together in the former leading German tax law firm Haarmann Hemmelrath & Partner. “The leaders complement each other with their specialisations, so that almost the entire spectrum of Noerr’s tax advice is represented at the head of the Tax and Private Clients Department”, said Dr. Tobias Bürgers, Noer Co-speaker.

The department provides the following services:

corporate and group tax

restructuring

acquisition structuring & joint ventures

finanzing & leasing

fund structuring

VAT

international & European tax law

tax compliance

private clients & succession planning

Schmidt became a Noerr partner on 1 May 2009. He came with a five-member team from a Düsseldorf tax boutique.

No least because of the arrival of that team, Noerr’s Tax, Advisory and Private Clients Department is well-positioned in all German offices. But not only there. In Central and Eastern Europe too, the law firm offers tax advice at the highest level in all its offices. Approx. 60 tax advisors, auditors and lawyers exclusively advising on tax law, 12 of whom (not including Hölzemann) are partners, belong to the department.

WTP Advisors, a global tax and business advisory consultancy, has announced an alliance with Hopkins Consulting, a UK-based tax and accounting firm. This partnership enables the award-winning WTP Advisors to offer tax and compliance services for both UK companies as well as multinationals with UK outfits.

“WTP and Hopkins share similar expertise and philosophies. We have a wealth of ‘big four’ experience but prefer stronger relationships with our clients which in turn lead to tangible, valuable results for their companies,” says Ian Boccaccio, co-founder and principal of WTP Advisors.

And both WTP Advisors and Hopkins Consulting have a history of winning clients away from the big four because of their ability to respond on a dime, their efficiency, and their technical know-how.

However, while most of WTP Advisors’ existing clients have international operations, they tend to engage the big four for their tax compliance and accounting needs abroad.

“They do this for convenience, because the big four can provide global coverage,” explains Boccaccio, “however, we hear that some clients are dissatisfied with the cost and quality of the product they receive so we want to provide a WTP alternative to these clients for their international needs, much in the way we market an attractive alternative in the United States.”

In short, bringing a WTP branded UK firm to market for its clients will give WTP Advisors the foot-in-the-door it needs to compete for international business. Hopkins has existing relationships with firms in Europe and in Ireland that WTP will seek to leverage.

“We are thrilled to be a part of WTP Advisors,” says Simon Hopkins, CEO and founder of Hopkins Consulting, “WTP’s expansion reflects its rapid success in this space, and supports the philosophy that people prefer a hands-on approach that emphasizes practical advice based on technical detail.” Hopkins began the consultancy after working for more than a decade with Ernst & Young, one of the largest tax consultancies in the world. While there, he worked with major multinational corporations including Coca-Cola, Harley-Davidson, Times Mirror, GB Airways and DKNY.

Mr. Nagel was formerly of counsel in Sullivan & Worcester’s Washington, D.C., office.

“Walt is a nationally recognized expert in multistate taxation of major corporations with particular expertise in telecommunications taxation,” said Lee A.
“The combination of Reed Smith’s preeminent, nationwide, state tax practice and its expansive geographic footprint provide precisely the right platform from which to expand my practice,” said Mr. Nagel. “In addition, the firm currently serves many of the nation’s top telecommunications firms, with whom I look forward to developing strong relationships. I am confident my capabilities will be of benefit to the firm’s clients.”

Mr. Nagel has counseled the Multistate Tax Commission on the development of a model telecommunications income-tax statute. He has also published numerous books and articles in his areas of expertise. A 1984 graduate of Rutgers University Law School, he earned an M.B.A. from Rutgers in 1988, and an LL.M. in Taxation from Georgetown University Law School in 1990.

“Many of us have worked with Walt over the past two decades,” said Washington, D.C. tax partner, Don Griswold. “He is a very talented tax professional, who we know will be able to help us continue the growth of this important practice, as well as contribute to our overall reputation for excellence.”

Simon has wide experience in the tax profession, having worked for the Inland Revenue and large international accountancy firms as well as operating his own practice. He currently works in the City of London for Argenta Taxation Consultants.

Taking up the appointment at the Association’s AGM today, Simon Braidley said:

“It is a great honour and privilege to become the President of the ATT.

“Founded 21 years ago, the ATT has now come of age. Our 21st year is the ideal launch pad to further promote the Association to our members and potential members. The majority of our branches will be hosting special 21st anniversary events. I look forward to attending as many of them as possible.

“A priority of my presidential year is to ‘engage the membership’. The surveys undertaken in 2009 have helped the ATT Council and its committees appreciate what our members and students want from us. As a result we are developing a strategy to take the Association through the next stage of its adult life. This includes our new website, overseas examination centres and the appointment of our first Technical Officer. I believe John Kimmer’s appointment will strengthen the ATT’s influence and impact on government and other policy makers.

“Additionally, the AGM has just ratified a special resolution allowing for the introduction of a new membership category of Fellow. The title of Taxation Technician (Fellow) for suitably qualified members is a fitting development in our 21st year.”

Simon succeeds David Stedman as President. He is himself succeeded as Deputy President of the ATT by Andrew Meeson (who is also chair of the ATT’s Technical Committee). Stuart McKinnon is the Association’s new Vice President.

The global independent professional tax services network, WTS Alliance, announced today that it had admitted an Australian member firm to its network, WTS Australia Consulting & Advisory, a group of experienced Corporate and International Tax Advisers.

WTS Alliance was the first global network of independent tax firms, formed in 2003. It was founded by German tax advisory firm WTS, headquartered in Munich. WTS World Tax Service is one of the largest German firms in its industry with more than 400 employees. It has six German offices from Frankfurt and Düsseldorf to Hamburg.

WTS Alliance selects one member firm per country and now has 27 member firms and strong partners in more than 90 countries. It is rapidly expanding to meet the demand for tax consulting services of international and major medium-sized companies all over the world, and Australia is its latest destination.

WTS Australia has been established by a former big four senior tax partner, Cameron Allen, as CEO with a former colleague, Julie Ling, and is currently in a drive to recruit talent and admit new specialist tax partners. Mr Allen has 20 years of professional tax consulting experience and has worked on a number of large transactions in his career, including corporate restructures, public floats, trade sales and ATO negotiations. He is highly regarded by clients for his ability to provide high level, innovative and practical tax advice on complex, and often demanding, transactions. He has extensive corporate and international tax experience and more recently has focussed on clients in the manufacturing, life science and technology sectors.

Commenting on the new Australian WTS member firm, WTS Alliance spokesperson and Chairman of WTS in Germany, Fritz Esterer said, “Australian companies will now have more choice when it comes to choosing experienced independent tax advisers rather than looking to the traditional global audit firms for tax services”.

WTS Australia CEO Cameron Allen is excited about the challenge and opportunity to build a national tax services firm and is delighted to be part of the WTS Alliance. He said the Australian market was long overdue for an independent tax services firm with a strong global network where personalised service and practical and innovative advice is paramount. “Our independence allows our people to focus on providing tax advice without the burden of supporting an audit practice or conducting time-consuming conflict evaluations”, Mr Allen said. “Similarly, clients will also see the benefit of a dedicated tax services firm that focuses solely on the client’s tax needs without the distraction of large firm bureaucracy and administration. We intend to build a practice that excites our people which in turn will result in greater satisfaction for our clients.”

About WTS Alliance
WTS Alliance is coordinated by the German firm WTS AG Steuerberatungsgesellschaft The international consultancy network has outstanding tax expertise with 27 Alliance members in 92 countries

Miller & Chevalier Chartered has announced that Robert S. Kirschenbaum has joined the Tax Department as a Member. He comes to the firm from Baker & McKenzie LLP, where he was a partner in that firm’s Transfer Pricing group.

Kirschenbaum is a recognized legal authority in the area of transfer pricing strategy and planning, and related tax controversy resolution. He represents U.S. and foreign-based multinational companies in a wide variety of industry sectors, including software, semiconductor, pharmaceutical, defense, financial services, and retail. A significant part of Kirschenbaum’s practice involves advising high-tech companies based in Silicon Valley. Miller & Chevalier has a long history of advising companies on the West Coast in the tax, employee benefits, litigation, and international trade areas. With the addition of Kirschenbaum and in light of the continued growth of Miller & Chevalier’s client base on the West Coast, the firm is establishing a presence in Palo Alto to provide enhanced service to these clients.

“We are so pleased to welcome Bob Kirschenbaum to the firm,” said Marianna Dyson, Chair, Miller & Chevalier. “He brings a wealth of significant government, industry and private practice experience in the transfer pricing area that will greatly benefit our multinational clients.”

Before joining Baker & McKenzie, Kirschenbaum was Team Leader for the Advance Pricing Agreement (APA) Program of the Internal Revenue Service (IRS). At APA, he was Japan Case Coordinator for the IRS Competent Authority negotiations and was responsible for negotiating and consummating approximately 40 unilateral and bilateral APAs.

“Transfer pricing is one of the most significant issues currently facing global enterprises,” said Patricia Sweeney, Chair of Miller & Chevalier’s Tax Department. “Bob is a recognized leader in the field and has an established reputation for his work helping companies to plan and defend their transfer pricing strategies, while structuring their businesses in a tax-efficient manner. In addition, he shares our commitment to exceptional client service, providing practical advice to meet client needs. Bob will be a valuable addition to our skilled team, which includes lawyers who have both senior government and private practice experience navigating complex matters in the international tax area.”

Transfer pricing presents challenging high-stakes tax issues and planning opportunities for multinationals today and is a critical component of proactively managing global tax obligations. It is also an area of intense focus by U.S. and foreign tax authorities, and significant disputes can arise. Some disputes can be prevented through careful planning or through APAs with one or more tax authorities, while others can be resolved through effective negotiation with taxing authorities and the mutual agreement process under tax treaties. Kirschenbaum has extensive experience assisting multinational companies in designing and implementing transfer pricing strategies and in resolving disputes proactively. His prior government experience serves him well in dealing with taxing authorities around the world.

Miller & Chevalier Chartered has announced that Stephen F. Gertzman has joined the Tax Department as a Member. He comes to the firm from Ernst & Young LLP, where he was a Principal and had served as its National Director of Federal Tax Accounting and Director of the Accounting Methods and Inventories Group in Ernst & Young’s National Tax Department.

Gertzman is widely recognized as one of the nation’s preeminent lawyers in the area of tax accounting, and his treatise, Federal Tax Accounting, is considered the leading authority on the topic. He has advised clients on the full scope of tax accounting issues and his industry experience covers virtually every major sector of the economy. His advice has often been sought by the U.S. Department of the Treasury and the Internal Revenue Service (IRS), and his writings have been cited in a number of court decisions.

“We are so delighted to welcome Steve to Miller & Chevalier,” said Marianna Dyson, Chair of Miller & Chevalier. “He brings an absolute wealth of knowledge and instant credibility in the area of tax accounting.”

“In addition to Steve’s recognized experience in tax accounting and his reputation for achieving extraordinary results for his clients, he has a reputation for great integrity in his dealings with the IRS and clients,” said Patricia Sweeney, Chair of Miller & Chevalier’s Tax Department. “The addition of such a preeminent legal authority strengthens and deepens our existing tax accounting capabilities and provides clients with an incredible level of knowledge, experience and value. Miller & Chevalier is extremely well positioned to advise clients in the current environment.”

Congress remains focused on identifying new sources of tax revenue, placing the IRS under ever-increasing pressure to close the “tax gap.” At the same time, the IRS is shifting much of its own investigative role to taxpayers themselves, putting unprecedented emphasis on transparency and disclosure. Pressure from other sources, including FIN 48, adds to the increasing stresses faced by corporate tax departments to “get it right.”

In this environment, however, getting it right is not always enough. By centralizing issue management, the IRS has changed dramatically the traditional dynamic encountered by taxpayers in defending their tax positions. This new landscape is particularly acute in the tax accounting area. Many of the issues identified by the IRS as raising the highest compliance concerns — and most likely to attract scrutiny on audit — are tax accounting issues. This heightens considerably the pressure on businesses in preparing, and equally importantly in defending, their tax accounting positions.

RSM Tenon has announced that it has acquired the London, Epsom, and Leicester advisory offices, the national Financial Management operations and the Thames Valley Recovery office of its public competitor, Vantis.

Completing today, the acquisition sees circa 300 staff augment the existing RSM Tenon teams, adding up to an estimated £27 million to the firm’s annual fee income, for a total cash consideration of approximately £7.0 million.

The deal brings significant extra Audit, Tax and Advisory work across the three locations, especially to RSM Tenon’s London operation, reflecting the Group’s commitment to growth in the Capital.

Andy Raynor, the Chief Executive of RSM Tenon Group PLC said

“We have always admired the underlying businesses within Vantis, continuing to deliver outstanding client service to entrepreneurs despite the difficulties of the holding company. The resilience and skill of the people joining our teams is reflected in their loyal client following. This is a seamless fit with our own operations.”

The Vantis deal comes less than 6 months after the merger with Bentley Jennison at the end of last year, reinforcing RSM Tenon’s reputation for being one of the most dynamic accountancy firms in the UK today. Raynor commented:

“With acquisitions in the last six months totaling almost £100m of potential revenue, RSM Tenon has demonstrated the ambition for growth that we have always encouraged in our clients. Our ability to act quickly in completing this advantageous transaction has been aided by the continuing successful integration of our earlier RSM Bentley Jennison acquisition. Processes created and tested in that merger will be activated immediately by our dedicated teams.”

John L. Harrington, who recently served as international tax counsel for the U.S. Department of Treasury, has joined Sonnenschein Nath & Rosenthal LLP, the law firm announced today. Prior to joining Treasury, Harrington was tax counsel for the U.S. House of Representatives’ Committee on Ways and Means. Harrington, who joins the firm as a partner in its Taxation practice, will reside in Sonnenschein’s Washington, D.C., office.

“Understanding tax policy on the domestic and international level, as well as its direction, is the key driver for business planning. The level of sophistication and expertise that John brings in this regard is a coup for our clients,” said Marc D. Teitelbaum, national chair of Sonnenschein’s Taxation Practice. “John’s distinguished service in government provides him with an exceptional background in the key administrative and legislative tax matters on the international level that will be critical for the next dozen years and beyond.”

Harrington joined the Treasury Department in 2001 and served as international tax counsel from 2007-2009. In that role, he worked extensively with the IRS on regulations and other guidance dealing with the foreign tax credit, subpart F, transfer pricing, cross-border activities and other international tax issues. He led tax treaty negotiations and drafted and reviewed technical explanations and revisions to existing treaties. Harrington also served as the United States representative at meetings of the Organisation for Economic Co-operation and Development (OECD) Committee on Fiscal Affairs and at World Trade Organization meetings on tax-related trade disputes.

“In light of the increasing focus on major tax policy changes, especially in the international context, joining the firm with the pending SNR Denton global combination just months away is an exceptional opportunity,” said Harrington. “The reputation of Sonnenschein’s tax and policy practices already made the firm stand out for me, and I am delighted to be part of building the next phase, during which international tax considerations truly will be an important factor for clients in every global business sector.”

Harrington began his legal career in private practice in Washington. He earned a J.D. degree from Columbia University School of Law, where he was a Harlan Fiske Stone scholar, and a B.S. degree from the University of Florida.

With more than 700 lawyers and other professionals in 13 offices in the United States and Europe, Sonnenschein Nath & Rosenthal LLP (SNR) serves the legal and public interest needs of many of the world’s best-known and most admired businesses, nonprofits and individuals.

On June 9, 2010, the partnerships of both SNR and UK-based Denton Wilde Sapte LLP (Denton) approved a combination to form SNR Denton, to become effective on September 30, 2010. The combination joins complementary practices with a disciplined focus on meeting evolving client needs in eight key sectors: Financial Institutions and Funds; Energy, Transport and Infrastructure; Insurance; Real Estate, Retail and Hotels; Technology, Media and Telecommunications; Health and Life Sciences; Manufacturing; and Government. With its focus on quality, the combination will include 1,400 lawyers and other professionals in 18 countries and 33 locations across four continents, including the US, UK, Europe, the Middle East, Russia and the CIS, South-East Asia, and a network of exclusively associated firms in Africa.

JPMorgan Chase & Co. today announced new responsibilities for three members of its senior leadership team:

    * Heidi Miller, head of Treasury & Securities Services (TSS), has been named President of International.
* Michael Cavanagh, Chief Financial Officer, will succeed Ms. Miller as Chief Executive Officer of TSS.
* Doug Braunstein, head of Investment Banking, Americas, will succeed Mr. Cavanagh as Chief Financial Officer.

“Over the years at JPMorgan Chase we have worked hard to build a highly talented senior management team,” said Jamie Dimon, Chairman and CEO. “In developing great leaders and building a strong company, we focus on continually broadening the experience of our executives and working to deploy their talents and expertise across the organization. Our firm has developed an excellent management bench, and today’s moves reflect our goal of building on our team’s experience and providing them with new opportunities to make our company even better.”

As part of today’s announcement, the company has created the new role of President of International. JPMorgan Chase has built a world-class international banking franchise, but the company believes prospects for further growth in all of our businesses outside the United States are significant. This important new role will augment – not replace — business lines around the world, helping them accelerate and prioritize their efforts and their investments for growth.

Working with her senior colleagues, Ms. Miller will develop a comprehensive and coordinated international business strategy and growth plan – ensuring that the company identifies opportunities for growth all over the world; accelerates its expansion in countries like China, Brazil, India, and Russia; seeks out opportunities in other emerging economies; properly resources and governs lines of business and functions; continues the build-out of local branches; and cuts out any bureaucracy and inefficiencies.

Ms. Miller will take the lead in further expanding our global Corporate Bank, managing it in close coordination with Investment Bank CEO Jes Staley as well as with TSS Head Mike Cavanagh. As part of her new responsibilities, Ms. Miller will also chair a newly formed International Operating Committee, consisting of the firm’s senior global leaders, and she will focus on growing our international branches across lines of business.

Jamie Dimon said, “The breadth and depth of Heidi’s international business and leadership expertise are virtually unmatched in our industry, and I’m very excited about her taking on this important new role.” Regarding her new responsibilities, Ms. Miller added, “JPMorgan Chase is uniquely positioned for extraordinary success and growth globally if we work together and execute well, and I’m very fortunate to be leading this effort.”

Mike Cavanagh, who has been the company’s Chief Financial Officer since 2004, will become CEO of the TSS business. As CFO, Mr. Cavanagh provided broad leadership throughout the company’s major merger integration efforts, and he played a key role in helping the company successfully navigate the financial crisis over the past few years.

“Mike Cavanagh has done an outstanding job as CFO of our company and has built one of the most respected financial teams in banking,” said Jamie Dimon, adding, “Mike is well-suited to build on Heidi’s success as the new head of TSS, one of our six major businesses.”

Expect an announcement on increase in CGT;

Possibility of £1,000 personal allowance increase;

Announcement of VAT rise in the coming months;

Corporation tax reforms discussion document will be issued.

Bill Dodwell, head of tax policy at Deloitte, considers what tax measures the Chancellor is expected to focus upon in the Emergency Budget:

Capital Gains tax
Most of the focus has been on the increase in capital gains taxation, with ‘generous exemptions for entrepreneurial activities’. We hope that shares owned by employees and unquoted shares in trading companies will benefit from lower rates. Both make vital contributions to entrepreneurial activities. We also hope to see relief for the effects of inflation – either through indexation (increasing the original base cost to allow for inflation), or through taper relief (reducing the gain, depending on the ownership period). Interestingly, the Office for Budget Responsibility forecasts lower CGT yields than previously calculated by the Treasury, due to lower prices for shares and property. This forecast definitely shows it will be hard to achieve the original hope of an extra £1bn-1.5bn annually from CGT.

Personal Allowances and National Insurance Contributions
The two big give-aways are the increase in personal allowances and the increase in NIC thresholds. Personal allowances are normally increased by the rate of RPI, in September. If we assume that inflation is about 3%, this would suggest an increase of around £200 (worth £40 for a basic rate payer) and it’s no doubt possible that the Chancellor may wish to announce a round £1,000 increase. Normally, increases in personal allowances benefit taxpayers at their marginal rate – so £200 for a basic rate taxpayer and £400 for a higher rate taxpayer. However, there have been signals that the benefit might be the same – £200 – for both higher rate and basic rate taxpayers. This adds to complexity in the tax system – but is cheaper to implement.

It is possible that the Chancellor will announce the married couples’ allowance put forward by the Conservatives. Under the Coalition agreement, the Liberal Democrats have agreed to abstain, rather than vote against the proposal. The allowance is intended to permit a spouse/civil partner with income below the personal allowance to transfer up to £750 of the unused allowance, provided that the recipient is a basic rate taxpayer. Consequently, the maximum benefit will be £150. Increasing the personal allowance will mean more married couples/civil partners will benefit. It’s thought that about one third of married couples will benefit from the allowance.

It’s likely we know what will happen to NIC. The rates for employers, employees and the self-employed will go up by 1% and the thresholds will be increased by £570 over the personal allowance for employees (the Labour Government plan) and £1,092 for employers (the Conservative plan). This should mean that employers would actually see an NIC reduction for employees earning up to £21,000 and employees earning up to £20,000 would benefit as well. Those earning above these thresholds would pay more.

VAT
The fourth major area of focus is VAT. Many expect that further tax increases will be needed. Consequently, it’s thought that there will be an increase in VAT – partly, no doubt, as the previous Government increased income tax and national insurance. Increasing the standard rate of VAT to 20% would cost someone on average earnings about £150pa.

We do not favour widening the VAT base, through adding VAT at 17.5%, in place of zero-rating. The key categories are food (£11bn); new housing (£4bn); public transport (£2.5bn) and water/sewerage (£1.3bn). Additionally, increasing the 5% charge on domestic fuel to 17.5% would raise £3.6bn. The difficulty with imposing VAT on these items is that the burden would fall disproportionately on the least well-off. Although benefits and tax credits could be increased to compensate the average household, the fiasco over the abolition of the 10% income tax band demonstrated that at least 1 million people (mainly those without children) do not receive benefits or credits.

Taking together the effect of a personal allowance increase of £1,000, the NIC changes and a VAT rise to 20%, those on median earnings (about £23,000) or below would be no worse off and those on more modest incomes could be £200pa better off. The top half of the earnings spectrum would see tax rises.

Pensions
The previous Government decided to cap tax relief on pension funding in respect of higher earners (principally those with income over £130,000). Regrettably the method chosen is complex and arbitrary. It has attracted widespread criticism from employers, pension providers and advisers. Most have suggested that a much better approach to reduce the cost of tax relief on pensions would be simply to set a much lower cap on annual pension contributions – say, £50,000. This would be much easier to understand; would not give anyone marginal tax rates of 100% and would not give pension trustees and employers significant implementation costs. We know that the new Government has been asked to reconsider the approach and it is to be hoped that a plan of this sort will be adopted.

Corporation tax reforms
Businesses will be keen to hear more about George Osborne’s five year plan to reform corporation tax. The Chancellor signalled at his recent speech to the CBI that his ambition is for the UK to have the most competitive corporate tax regime in the G20. This will clearly include rate reductions, a lighter CFC regime (the rules which charge UK tax on low-taxed overseas profits of UK groups) and incentives for managing intellectual property (patents, trademarks, brands and other intangible assets)in the UK.

At the same time, the Chancellor may consider implementing the proposals from the Dyson review, which include redirecting R&D tax credits towards Hi-tech companies, small firms and start-ups, as well as supporting manufacturing. Equally, it’s thought that part of the cost of these benefits will be paid through reducing some allowances. It’s clear that the Government will be issuing a discussion document for business to debate.

At the same time, we hope to hear more about the plans for a Patent Box regime (a special tax rate of 10% for royalties from patents) and also how the Government proposes to take forward the current plans to reform CFCs and the taxation of foreign branches. This latter area is critical for the insurance industry, which is facing changes to its capital requirements, in the Solvency II regime. Solvency II is pushing insurers to conduct their business through branches, rather than subsidiaries. Without an exemption for the income from foreign branches, insurers may well move activities to other EU states, which do offer an exemption or low taxation.

The Coalition agreement set out several other areas for consideration, including: anti-avoidance; the taxation of non-domiciled individuals; and the approach to taxing contractors and small business. Whether we see Discussion documents in these areas is doubtful, given the short time that the Treasury has had to consider such a wide range of complicated tax issues.

Gary Todd has joined EY Jersey from KPMG.

Mr Todd, a specialist in Jersey financial services tax, will work alongside Neil Oliver providing clients with a wide-ranging service offering across the local, UK and international tax arenas.

Gary joins a growing Ernst & Young team and brings with him extensive knowledge of local tax, gained from 25 years’ experience at the States of Jersey Taxes Office. During this time he was involved in policy development and revising Jersey’s tax law.

Five years ago Gary made the transition from the public sector to KPMG.

“This is a time of great change for the Island as Jersey’s corporate tax system comes under review,” said Gary.

“As we await the launch announcement for the zero-ten policy consultation document this is a welcome opportunity to examine where Jersey is and ensure that we have the right tax system for Jersey.”

A Jerseyman, upon finishing his schooling in the island, Gary joined the Jersey Tax Office in 1979. Having qualified as a Chartered Tax Adviser (CTA) in 1998, he successfully worked his way up to the position of Fiscal Policy Director.

This role came at a time of much development for the island and its taxation policies including the Income Tax Instalment System (ITIS), the taxation of benefits in kind, penalties for late filing of tax returns and restriction of interest paid. He was also involved in the initial stages of planning zero-ten as the States began to formulate its policies, so is particularly well placed to understand the implications of any changes.

Channel Islands’ managing partner, Andrew Dann said: “Gary’s appointment is a reflection of our dedication to providing the highest levels of service in response to the growing demand for expert advice.

“This is a time when the Channel Islands are seeing historic changes to their corporate tax regimes as well as enormous changes to the tax legislation within the UK. Gary will provide clients with the insight, advice and guidance they require not only at a corporate level but also with regards to personal tax implications, drawing on his extensive experience and expertise of Jersey tax.”
